BACKGROUND
The City of Laredo Public Health Department will be impacted by House Bill 2844, passed during the 89th Texas Legislative Session, which establishes a statewide regulatory framework for mobile food vendors and certain retail food establishments under the Texas Department of State Health Services (DSHS), preempting portions of local regulation and standardizing licensing, permitting, and enforcement requirements.
The law requires mobile food vendors to obtain a state-issued license and limits the Department's ability to impose additional permits, fees, or regulations that conflict with state law, including restrictions on local fee structures and expanded exemptions for certain small-scale food businesses.
HB 2844 also shifts primary regulatory oversight to DSHS, with local health departments having the option to enter into agreements with the state to conduct inspections and enforcement activities.
The law will be fully implemented on July 1, 2026.
DSHS is exploring subcontracting with local jurisdictions and is in the early stages of contract development. The vendor information form would allow City of Laredo to continue discussion, potential negotiation and agreement to conduct such inspections on behalf of DSHS.
