An Ordinance of the City of Laredo, Texas, authorizing the City Manager to execute a First Amendment to the Ground Lease between TowerCo Special, LLC, Delaware limited liability company (“Licensor”), and the City of Laredo (“Licensee”), for space on the tower located at 1313 West Calton Road for the installation and operation of the 800 MHz Public Safety System antennas and related ground equipment. Term of the Amendment is one initial term of five years commencing January 23, 2026 and ending January 22, 2031, with five additional five year renewal options. The annual fee will remain at the then current rate with a CPI annual escalator. Funding is available in the Information Technology Fund.

BACKGROUND
Time Warner Cable d/b/a Texas Cable Partners, a Corporation (“Original Licensor”) and Licensee are parties to that certain Tower Space Licensing Agreement, dated January 23, 2006 (the “Agreement”) with regard to a wireless communication tower located at 1313 West Calton Road, Laredo, TX 78041 (the “Site”). TowerCo (“Licensor”) subsequently acquired the Site from Original Licensor.
This Agreement amends and restates the ground lease for an initial term of five (5) years commencing January 23, 2026 and ending January 22, 2031, with five (5) additional five (5) year renewal options at the then current rate with a CPI escalator. The current rate is $3,305.69 per month.
The leased premises are for the installation and operation of the cabinets, repeaters and antennas mounted at the 340 ft level on the tower, rack space on the ground shelter and ground space for a backup generator. This equipment is for the 800 MHz Public Safety Radio System.
