BACKGROUND

The City of Laredo Public Health Department currently employs Yonghong Luo as an Air Quality Specialist. In this role, Ms. Luo has been instrumental in the development and implementation of the City’s Air Quality Monitoring Program and Ethylene Oxide (EtO) environmental monitoring initiatives, which support the City’s ongoing efforts to monitor environmental conditions and protect public health.

 

Ms. Luo currently works under employment authorization associated with her F-1 student visa and Optional Practical Training (OPT). Her present employment authorization is expected to extend through May 10, 2027. To ensure continuity of the City’s environmental monitoring programs and to retain specialized technical expertise within the Public Health Department, Ms. Luo has requested that the City consider sponsoring her for an O-1A Nonimmigrant Visa for Individuals with Extraordinary Ability in Science.

 

The O-1A visa classification is established under federal immigration law and allows a United States employer to petition for a nonimmigrant worker who possesses extraordinary ability in science, education, business, or athletics. Sponsorship requires the employer to submit Form I-129, Petition for a Nonimmigrant Worker, to the United States Citizenship and Immigration Services (USCIS), along with supporting documentation demonstrating the employee’s qualifications and the employer’s need for the employee’s services.

Ms. Luo has indicated a willingness to assist with preparation of the required documentation and has also expressed a willingness to personally cover certain filing costs associated with the petition if permitted.

 

Human Resources and the City Attorney’s Office have reviewed the request and determined that sponsorship of an O-1A visa may be permissible where the employee’s services directly advance a legitimate municipal program and the City receives a clear public benefit. The work performed by the Air Quality Specialist directly supports the City’s environmental monitoring and public health initiatives, which constitute an ongoing governmental function.

 

Approval of this item would authorize the City of Laredo to serve as the petitioning employer for the purposes of submitting the O-1A visa petition to USCIS.
