A Resolution authorizing the City Manager to execute an Advanced Funding Agreement (AFA) No. 3483-02-002 with the Texas Department of Transportation (TXDOT) for an On-System Project funded through the Urban Connectivity Program, Metropolitan Area Corridor Program, Preventative Maintenance & Rehab Program, and Surface Transportation Program Metropolitan Mobility. This project consists of constructing a new location roadway, SH 84, from FM 1472 to IH 35, approximately 8.43 mi long. The project includes the limits of the new location roadway Hachar-Reuthinger, previously referenced in AFA 0922-33-165. As a result, the original AFA for CSJ: 0922-33-165 will be terminated. The City of Laredo and the Texas Department of Transportation have negotiated terms of an Advanced Funding Agreement in the estimated amount of $210,626,999.00, with federal participation in the estimated amount of $126,294,218.00, state participation in the estimated amount of $49,266,346.00 and local participation in the estimated amount of $35,700,000.00. State participation will cover 100% of environmental, ROW mapping, PS&E and direct state costs, including overruns. The City of Laredo shall acquire the necessary Right-of-Way and obtain necessary Utility clearances with local funds, including overruns.

PREVIOUS COUNCIL ACTION

On November 20, 2023, the City Council approved Resolution 2023-R-220 requesting for an executive session pursuant to Texas Government Code 551.072 to deliberate the acquisition of real property related to the Hachar-Reuthinger roadway and authorizing the City Manager to execute an Advanced Funding Agreement (AFA) No. 3483-02-002 with the Texas Department of Transportation (TXDOT) for an On-System Project funded through the Urban Connectivity Program, Metropolitan Area Corridor Program, Preventative Maintenance & Rehab Program, and Surface Transportation Program - Metropolitan Mobility. 

 

On February 6, 2023, the City Council approved Resolution 2023-R-053 expressing the City’s support for the Texas Department of Transportation (TxDOT) to designate Hachar-Reuthinger extension as a new location On-System Roadway from FM 1472 to IH35 West Frontage road. The City of Laredo will be obligated to assume future responsibility to operate and maintain Spur 400, San Bernardo Ave., and Jaime Zapata Memorial Highway; and providing an effective date.

 

On April 6, 2021, the City Council approved Resolution 2021-R-087 authorizing the City Manager to amend Two Advanced Funding Agreements (AFA) with the Texas Department of Transportation (TXDOT) for a Surface Transportation Program Metropolitan Mobility Off-System Project. The amendment to AFA for CSJ#0922-33-165 will add CSJ#0922-33-166 to the agreement to include the entire limits of Hachar-Reuthinger project onto this AFA. As a result, the original AFA for CSJ: 0922-33-175 will be terminated. The total estimated cost for the project is $59,268,383.00. Estimated total amount of local participation is $9,242,941.00 of which $8,213,941.00 shall be paid to TxDOT sixty (60) days prior to contract letting in August 2023. Funding is subject to approval of the State Infrastructure Bank (SIB) Loan.

 

On April 6, 2021, the City Council approved Resolution 2021-R-097 authorizing the filing of an application for financial assistance from the State Infrastructure Bank in the amount of Nine Million Two Hundred Forty-Two Thousand Nine Hundred Forty-One Dollars $9,242,941.00 as City’s participation in a Surface Transportation Program Metropolitan Mobility Off-System for the entire limits of Hachar-Reuthinger Project. Authorizing City Manager to act on behalf of the City of Laredo in all matters relating to the participation.

 

BACKGROUND

On May 25, 2023, the Texas Transportation Commission approved the City of Laredo, Webb County, and the Laredo District's request for the designation of SH 84 on the state highway system along a new location from FM 1472 eastward to I-35, a distance of approximately 8.0 miles. Pursuant to the Texas Transportation Code, §§201.103 and 221.001, the executive director of the Texas Department of Transportation recommended this action. The Texas Transportation Commission (commission) finds that this action will facilitate the flow of traffic, promote public safety, maintain the continuity of the state highway system, and is necessary for the proper development and operation of the system.

IT IS THEREFORE ORDERED by the commission that SH 84 is designated on the state highway system along a new location from FM 1472 eastward to I-35, a distance of approximately 8.0 miles.
