PREVIOUS COUNCIL ACTION

The item was introduced by the Honorable Mellissa R. Cigarroa at the regular council meeting of March 18, 2024.

 

Pursuant to Ordinance 2020-O-130, there are two (2) annexation cycles per year.

 

BACKGROUND

Texas Local Government Code Section 43.0673 requires a public hearing before the City Council.  The public hearing was held on February 5, 2024 and February 20, 2024.  The petition for annexation was presented before the Planning and Zoning Commission on December 7, 2023 and December 21, 2023 for a recommendation.  The petition for annexation will subsequently go before City Council for final reading of the ordinance on April 2, 2024.

Tract 5 is as follows:

Voluntary Annexation:
Tract 5 - 13.15 acres, more or less, located south of State Highway 359 and east of Las Missiones Boulevard.

Petitioner: Jesse J. Martinez - J&H Rentals, LLC.

 

COMMITTEE RECOMMENDATION

The Planning and Zoning Commission reviewed the proposed annexation and zoning designation on December 7, 2023 and December 21, 2023, and in a 7 to 0 vote, recommended approval of the annexation and initial zoning of B-4 (Highway Commercial District) and B-3 (Community Business District).

Proposed use: B-4 (Highway Commercial District) and B-3 (Community Business District)

Site: Existing industrial site currently undergoing the platting process. Industrial site has been in use prior to 2002.

Surrounding land uses: Adjacent to this tract to the east is the Las Missiones Residential Development. To the north and south are existing industrial type uses. To the east in the unincorporated area is a junkyard and a few residences. This tract is a part of the area known as Old Milwaukee West (an unplatted colonia).

Comprehensive Plan: The Future Land Use Map identifies this tract as Neighborhood Mixed Use and Medium Density Residential. RE:

Transportation Plan: The Future Transportation Plan identifies State Highway 359 as an Expressway. Las Missiones Boulevard is classified as a Collector:

Staff supports the application and amended initial zoning.  The tract abuts an existing residential development to the west (Las Missiones).

IMPACT ANALYSIS
B-4 (Highway Commercial District):
The purpose of the B-4 District (Highway Commercial District) is to provide for those businesses and services serving a regional area which are to be located primarily along principal (major) arterial streets or the freeway, as classified in the Transportation Plan of the City of Laredo. It is intended for this zoning classification to exist primarily along principal arterial streets or the freeway and to impose site development regulations to ensure adequate access of all uses within this classification.

B-3 (Community Business District)
The purpose of the B-3 District (Community Business District) is to provide for those businesses and services serving a trade area larger than a neighborhood, but smaller than the entire city and located primarily along minor or principal arterial streets, as classified in the Transportation Plan of the City of Laredo. It is intended for this zoning classification to exist primarily abutting minor or principal arterial streets while preserving established residential neighborhoods along such streets.

Is this change contrary to the established land use pattern?
No. The area is part of an existing industrial site.

Would this change create an isolated zoning district unrelated to surrounding districts?
No. The tract is part of a larger tract already within the corporate limits of the city of Laredo that is zoned M-1. The area immediately to the north was rezoned from R-1 to M-1.

Will change adversely influence living conditions in the neighborhood?
No. While the site is currently used as an industrial site, it abuts an existing residential neighborhood.

Are there substantial reasons why the property cannot be used in accordance with existing zoning?
