PREVIOUS COUNCIL ACTION

Pursuant to Ordinance 2020-O-130, there are two (2) annexation cycles per year.

 

BACKGROUND

Texas Local Government Code Section 43.0673 requires a public hearing before City Council. The public hearing was held on June 24, 2024. The petition for annexation was presented before the Planning and Zoning Commission on May 16, 2024 for a recommendation. The petition for annexation will subsequently go before City Council for final reading of the ordinance on August 5, 2024.

Tract 4 is as follow:

Voluntary Annexation:
Tract 4 - 9.983 acres, more or less, located north of State Highway 359 and east of Camino Nuevo Road.

Petitioner: Christopher M. Cabello on behalf of CAS Cabello Enterprises, LLC.

 

COMMITTEE RECOMMENDATION

The Planning and Zoning Commission reviewed the proposed annexation and zoning designation on May 16, 2024 and in a 6 to 0 vote, recommended approval of the annexation and initial zoning.

Proposed Use: M-1 (Light Manufacturing District) - Existing automobile impound yard, automobile wrecker service, auto auction.

Site: Existing automobile impound yard, automobile wrecker service, and automobile auto auction.

Surrounding land uses: The area immediately to the north and east is undeveloped land.  The land to the west has begun the platting process for an industrial site.  Further to the west is the Webb County Youth Village and the Laredo Flea Market.  To the south is the Suarez Brothers Crane and Hauling Service.

Comprehensive Plan: The Future Land Use Map identifies this tract as Mixed Use Center. RE:

Transportation Plan: The Future Transportation Plan identifies State Highway 359 as an Expressway.

Staff supports the annexation.
Staff supports the initial zoning.  While the site is not in conformance with the Future Land Use designation of Mixed Use Center, the site is adjacent to M-1 zoning and a proposed industrial park to the west.  The proposed zoning is compatible with surrounding uses.

IMPACT ANALYSIS
M-1 (Light Manufacturing District):
The purpose of the M-1 (Light Manufacturing District) is to encourage the development of manufacturing and wholesale business establishments which are clean, quiet, and free of hazardous or objectionable elements such as noise, odor, dust, smoke or glare. Research activities are encouraged. This district is further designed to act as a transitional use between heavy industrial uses and other less intense and residential uses.

Is this change contrary to the established land use pattern?
No.  The site is an existing automobile impound yard, automobile wrecker service, and an automobile auto auction facility.  The tract to the south is used as a crane and hauling service.

Would this change create an isolated zoning district unrelated to surrounding districts?
No.  The area to the north and west is zoned M-1.  The area to the east and immediately south is unzoned.

Will change adversely influence living conditions in the neighborhood?
No.  There are no residential neighborhoods in the area.

Are there substantial reasons why the property cannot be used in accordance with existing zoning?
